General Terms and Conditions – Hotel Essen mit Apartments
Translation for information. In case of discrepancies, the German version prevails.
§ 1 Scope
- These terms apply to contracts for the rental of hotel rooms and apartments for accommodation and to all related services of Hotel Essen mit Apartments, operated by Neumann Hausverwaltung UG (haftungsbeschränkt), Südstraße 59, 47533 Kleve, Germany, Local Court (Amtsgericht) Kleve HRB 13603, VAT ID DE301555763 ("Hotel").
- Subletting the rooms or using them for purposes other than accommodation requires the Hotel's prior consent in text form.
- The guest's or booker's own terms apply only if expressly agreed.
§ 2 Conclusion of contract, contracting parties
- The contract is concluded when the Hotel accepts the guest's request. The Hotel confirms the booking in text form (e.g. by email).
- The contracting parties are the Hotel and the guest. If a third party booked on behalf of the guest, that party is jointly and severally liable with the guest.
- For bookings via online portals, the terms agreed there also apply, insofar as they do not contradict these terms.
§ 3 Services, prices, payment
- The Hotel provides the booked rooms and the agreed services.
- The guest pays the agreed or applicable prices. These include statutory VAT. Local taxes owed by the guest (e.g. accommodation tax) are not included and are charged separately.
- The Hotel may request a reasonable advance payment or security (e.g. credit card guarantee). The amount and due date are stated in the booking confirmation.
- Invoices are due without deduction at the latest on departure. The Hotel is not obliged to accept foreign currencies or cheques.
- The guest may only set off undisputed or legally established claims.
§ 4 Withdrawal by the Hotel
- The Hotel may withdraw from the contract for objectively justified reasons, in particular if
- force majeure or other circumstances beyond the Hotel's control make performance impossible;
- rooms are booked with misleading or false information on essential facts, e.g. the identity of the guest or the purpose of the stay;
- there is good reason to believe that the use endangers the smooth operation, safety or reputation of the Hotel;
- an agreed advance payment or security is not made on time.
- In these cases the guest has no claim to compensation.
§ 5 Cancellation by the guest
- The guest may cancel free of charge up to 3 days before arrival, unless otherwise agreed in the booking confirmation (e.g. non-refundable rates).
- In case of later cancellation or no-show, the guest remains obliged to pay the agreed price. The Hotel credits saved expenses and income from re-letting. Alternatively, the Hotel may charge the following flat rates:
- up to 24 hours before arrival: [40] % of the room price;
- thereafter or in case of no-show: [80] % of the room price, or [70] % for half or full board.
- The guest may prove that the Hotel suffered no damage or significantly less damage.
- Cancellations must be made in text form.
§ 6 Arrival and departure
- Booked rooms are available from [3:00 pm] on the day of arrival. There is no right to earlier availability.
- If a room is not occupied by [6:00 pm] and no later arrival was agreed or guaranteed, the Hotel may let the room to others.
- Rooms must be vacated by [11:00 am] on the day of departure. For later vacating, the Hotel may charge 50 % of the current room rate until 6:00 pm and 100 % thereafter, unless otherwise agreed.
- The guest must complete the registration form required by law online.
§ 7 Liability
- The Hotel is liable without limitation for injury to life, body or health and for damage caused by intent or gross negligence of the Hotel, its legal representatives or agents.
- In case of slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
- Liability for items brought into the Hotel is governed by the statutory provisions (§§ 701 et seq. German Civil Code). The Hotel has no safe. Guests keep money, securities and valuables at their own responsibility. We recommend not bringing large amounts of cash or valuables.
- Providing a parking space does not create a safekeeping contract. The Hotel is liable only under paragraphs 1 and 2.
- The guest is liable for damage to Hotel property culpably caused by the guest, fellow travellers or visitors.
§ 8 House rules, smoking, pets
- The guest observes the house rules and shows consideration for other guests, especially during quiet hours from 10:00 pm to 7:00 am.
- Smoking (including e-cigarettes) is prohibited throughout the Hotel, including the rooms. In case of violation, the Hotel may charge a special cleaning fee of € [150]; the guest may prove lower damage. Costs of fire brigade call-outs are borne by the person responsible.
- Pets are only allowed with prior consent at € [15] per night. The guest is liable for damage caused by the animal.
§ 9 Use of the internet access (Wi-Fi)
- The Hotel provides its guests with internet access via Wi-Fi as a voluntary, free additional service. There is no right to permanent availability, a certain bandwidth or the usability of specific services.
- The guest undertakes to use the internet access only in accordance with applicable law. In particular, the following is prohibited:
- downloading, offering or distributing copyright-protected works (e.g. films, series, music, software, games) without authorisation, in particular via file-sharing or peer-to-peer programs (e.g. BitTorrent, eMule) or similar services;
- accessing or distributing illegal content, in particular criminal, harmful to minors or defamatory content;
- sending mass emails (spam) and attacks on third-party systems or networks;
- passing on access data to persons who are not guests of the Hotel.
- The guest is responsible for all actions carried out via their access and supervises use by accompanying minors.
- If the guest culpably breaches these obligations, the guest indemnifies the Hotel against all resulting third-party claims, including reasonable legal defence costs.
- To prevent misuse, the Hotel may block individual services, ports or websites, limit bandwidth and suspend access in whole or in part if there is reasonable suspicion of a breach.
- Data is transmitted over a shared network. The guest is responsible for protecting their devices and data (e.g. antivirus, encryption).
- The Hotel is liable for damage to devices or data loss from Wi-Fi use only under § 7.
Short notice for login page and access card: By using this Wi-Fi you accept our terms of use. File sharing (e.g. BitTorrent) and illegal downloading of films, series or music are prohibited.
§ 10 Data protection
The Hotel processes the guest's personal data in accordance with the GDPR and German data protection law, in particular to perform the contract and to fulfil the statutory registration obligation. Details are in the privacy policy at [link].
§ 11 Final provisions
- Amendments or additions to the contract must be made in text form.
- The place of performance and payment is the Hotel's registered office.
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of their country of habitual residence.
- The exclusive place of jurisdiction for commercial transactions is the Hotel's registered office.
- The Hotel does not participate in dispute resolution proceedings before a consumer arbitration board.
- Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. The statutory provisions apply instead.
- These terms are available in German, English and Dutch. In case of discrepancies, the German version prevails.
